Not being an expert on tripods, could this one also be used as a regular fixed tripod for taking photos?
There is nothing to stop you from taking photos while using this head, however the camera will only align in a landscape position. To turn the camera in to portrait you will need an L-Bracket such as the Manfrotto Q2 L Bracket.

Well I think this tripod work very good. And I was exactly shooting with mine in construction in Hati, you can customize any position you want with this tripod. It's a good deal so I thing yes he can work well for scoping ocean birds easily.

How does one keep it from unscrewing when panning left? I can't figure this out. Frustrating.
If you look on the underside of the top plate that the head is screwed into, you will see a single set screw. Using a small flat head screwdriver, tighten that screw.

There is a set screw on the underside that you have to loosen.
