The B&H AT HOME SELF PORTRAIT SWEEPSTAKES (the “Sweepstakes”) is void where prohibited by law and is sponsored by B & H Foto & Electronics Corp., 440 Ninth Avenue, New York, NY 10001 (“B&H” or “Sponsor”). The Sweepstakes is not sponsored or endorsed by Twitter, Instagram or Facebook in any way.
Entry Period/Methods of Entry. The Sweepstakes will run from Wednesday, May 6, 2020 at 9:00AM EDT until Wednesday, May 13, 2020 at 11:59PM EDT (the “Entry Period”). Entries submitted outside the Entry Period are void. Enter the Sweepstakes via any one of the following methods: (1) on Twitter, tweet a self-portrait during the Entry Period using the hashtag #BHPhotoChallenge and tag @bhphotovideo (“Twitter Entry”); (2) on Instagram, post a self-portrait during the Entry Period using the hashtag #BHPhotoChallenge and tag @bhphoto (“Instagram Entry”) (Instagram stories are not a valid form of entry); (3) on Facebook, share a self-portrait during the Entry Period using the hashtag #BHPhotoChallenge and tag B&H Photo Video Pro Audio (“Facebook Entry”) (Twitter, Instagram and Facebook, each, a “Platform”); or (4) send an email to [email protected] containing your name, address, phone number, a reference to the B&H AT HOME SELF PORTRAIT SWEEPSTAKES in the subject field, and the subject(s), if any, about which you are interested in receiving future emails from B&H (e.g. photo, video, audio, computers, home theater, portable entertainment ) (optional), (“Email Entry”) (all entry options collectively, an “Entry” and all persons submitting an Entry, an “Entrant”). Entries must not, in the sole and absolute discretion of the Sponsor, contain obscene, provocative, defamatory, sexually explicit, or otherwise objectionable or inappropriate content. Entries deemed by Sponsor to be inappropriate will be disqualified. Entries owned by a third party, or the use of any trademarks, service marks, logos, brands, or products owned by a third-party are not acceptable for entry into the Sweepstakes. Limit 4 entries per person (1 via each Platform and 1 Email Entry).
Winner Selection/Prizes/Odds. On Thursday, May 14, 2020 at approximately 12:00PM EDT, B&H will randomly select one (1) grand prize winner (the “Grand Prize Winner”) and (3) runner up winners (the “Runner Up Winners”) from among all eligible Entries (the Grand Prize Winner and the Runner Up Winners, each being, a “Winner” and, collectively, the “Winners”). On Thursday, May 14, 2020 at approximately 3:00PM EDT, the Winners will be contacted via the Platform on which their winning Entry was submitted, or by Email if an Email Entry is selected. The Grand Prize Winner will receive one (1) Sony Alpha a7 III Mirrorless Digital Camera with 28-70mm Lens and Accessories Kit (B&H item #SOA73KK, having a retail value of $2,198.00) (the “Grand Prize”). The Runner Up Winners will each receive one (1) LaCie 1TB Rugged BOSS USB 3.1 Type-C External SSD (B&H item #LASTJB100080, having a retail value of $499.95) and one (1) SanDisk 64GB Extreme PRO UHS-I SDXC Memory Card (B&H item #SAEPSD64GBG, having a retail value of $18.99) (the “Runner Up Prize” and, together with the Grand Prize, a “Prize”). No cash or other substitutions will be offered. Winner selection is in the sole and absolute discretion of the B&H Social Team. No Entrant will be eligible to win more than one Prize. If multiple Entries are selected by a single Entrant, such Entrant will only receive the Prize allocated to the first Entry selected. Any taxes are the sole responsibility of the Winners. The odds of winning depend on the number of eligible Entries received.
Identity of Winners/Eligible Participants. The Winners will be identified by the email account and/or username associated with the Platform account from which their Entry was submitted, or the email account provided with an Email Entry. An email account holder shall mean the natural person assigned to such email account by the internet access or online service provider or other organization responsible for assigning email addresses for the domain associated with such email account. Any issues regarding the identity of the Winners shall be resolved by Sponsor in its sole discretion. The Sweepstakes is only open to residents of the United States that are at least eighteen (18) years of age on their Entry date. The Sweepstakes is not open to employees of Sponsor, their immediate families, any person domiciled with such employees, or any affiliates or subsidiaries of Sponsor.
Entry Ownership/Entrant Agreements. Entrants retain full ownership and copyrights to their Submission. However, by entering the Sweepstakes, Entrants grant Sponsor an irrevocable, non-exclusive, fully paid and royalty-free, worldwide, limited license to use, modify, delete from, add to, publicly perform, publicly display, reproduce and translate their Entry for any purpose, including commercial use, in any media formats now known or hereinafter devised and through any media channels now existing or hereinafter created, in perpetuity. Entrants also agree: (a) to be bound by these Sweepstakes Rules; (b) that any claims related to this Sweepstakes shall be resolved individually without resort to any form of class action and that awards shall be limited to actual out-of-pocket costs incurred in entering the Sweepstakes, and shall not include incidental or consequential damages or attorneys’ fees; and (c) that any actual or perceived ambiguities in these rules shall be interpreted by Sponsor in its sole discretion. Entrants consent to be contacted by Sponsor in connection with the Sweepstakes.
Limitation of Liability/Sponsor Modification/Cancellation Rights/ Choice of Law/ Venue/ Winners List. Entrants hereby fully and completely release Twitter, Instagram and Facebook from any and all liability in connection with this Sweepstakes. Sponsor is not responsible for incomplete Entries or for failure to receive entries due to technical failures or human error of any kind. Winners agreee that Sponsor will have no responsibility for losses or damage of any kind resulting from the acceptance, possession, or use of the Prizes. Except where prohibited, participation in the Sweepstakes constitutes Entrant’s consent to the publication of his or her name by Sponsor in any media for commercial or promotional purposes without limitation or further compensation subject to Sponsor’s Privacy Policies. Sponsor may disqualify from the Sweepstakes any person it determines, in its sole discretion, to have attempted to or actually tampered with or otherwise abused any aspect of the Sweepstakes. Sponsor reserves the right, in its sole discretion, to modify or terminate the Sweepstakes in the event of any act, occurrence or reason that causes Sponsor to believe that the integrity, administration or fairness of the Sweepstakes has been compromised. Entrants agree that in the unlikely event a dispute arises in connection with this Sweepstakes, it will be governed by the laws of the State of New York and heard exclusively in a court of applicable jurisdiction in the County and State of New York irrespective of any choice of law provisions to the contrary. To receive the name of the Winners by U.S. mail, please mail a self-addressed stamped envelope to: B&H Foto & Electronics Corp., Attn: B&H At Home Self Portrait Sweepstakes, 440 Ninth Avenue, New York, NY 10001. Any Winners List request must be received by Sponsor within one (1) year of the date the Sweepstakes is conducted.
