B&H Foto & Electronics Corp. ("B&H") Product Reviews Terms and Conditions
These Terms and Conditions, in addition to the B&H User Agreement and Disclaimer ("User Agreement"), and the B&H Privacy & Security Policies ("Privacy Policy"), govern your use of the Product Reviews feature. To the extent of any conflict between the User Agreement and Privacy Policy, and these Terms and Conditions, these Terms and Conditions shall control.
By submitting any content ("Content") to bhphotovideo.com (the "Site"), you represent and warrant that:
- You are the sole author of the Content and owner of the intellectual property rights in such Content;
- You are at least 13 years old; and
- Use of the Content does not violate these Terms and Conditions and will not cause injury to any person or entity.
You further represent and warrant that you shall not submit any Content:
- that is known by you to be false, inaccurate or misleading;
- that infringes any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy;
- that violates any law, statute, ordinance or regulation;
- that is, or may reasonably be considered to be, defamatory, libelous, hateful, racially or religiously biased or offensive, unlawfully threatening or unlawfully harassing to any individual or entity;
- that includes any information that references other websites, addresses, email addresses, contact information or phone numbers; or
- that contains any computer viruses, worms or other potentially damaging computer programs or files.
You agree to indemnify and hold harmless B&H and its affiliates, officers, directors, agents, employees and third-party service providers from all claims, demands, damages, costs and expenses of every kind and nature, known and unknown, including without limitation reasonable attorneys' fees, arising out of a (i) any Content submitted by you, (ii) your breach of these Terms and Conditions or (iii) your violation of any law or the rights of a third party.
For any Content that you submit, you grant B&H a royalty-free, irrevocable, transferable right and license to use the Content for any and all purposes including, but not limited to, to copy, delete in its entirety, adapt, publish all or any portion of the content, translate, create derivative works from and/or sell and/or distribute such content and/or incorporate such Content into any form, medium or technology throughout the world, in all cases without compensation to you.
All Content that you submit may be used in B&H's sole discretion. B&H reserves the right to deny, condense or delete any Content on the Site in its sole discretion, including without limitation, content that B&H deems to violate applicable content guidelines or any other provision of these Terms and Conditions, the User Agreement or the Privacy Policy. B&H reserves the right to remove or to refuse to post any submission for any reason. You acknowledge that you are responsible for the Contents of your submission. If you include any personally identifiable information, such as your name, in any Content, such personally identifiable information may be accessed by anyone that uses the Site. You should not submit any information you wish to remain private.
By submitting your email address to B&H in connection with your Content, you agree that B&H and its third party service providers may use your email address to contact you about the status of your review and for other administrative purposes.
