Whether the item is brand new cannot be guaranteed by the package at all. Check the serial number from Apple, check the battery cycle count.

Mine came with the full warranty so Im not sure what gray market is, but I also purchased Apple care. These 2016s are jinxed. So word to the wise..... if you purchase it.... get Apple care!!!
